Detailed below you will find the Snohomish County Traffic and Vehicle Code.  Remember, however, that the Snohomish County Traffic and Vehicle Code is largely an enabling statute.  This means that in large part it simply adopts the state statutes that contain the specific language that applies to most Snohomish County speeding and traffic tickets.

Chapter 11.04 PARKING VIOLATIONS


11.04.010 Parking violations.
Except when necessary to avoid conflict with traffic or in compliance with the law or the direction of a policeofficer or official traffic-control device, or when a vehicle is disabled, it is unlawful for any person to:
(1) stop, stand, or park a motor vehicle upon ways designed and designated by an official sign for pedestrian, animal, or nonmotor vehicular traffic, or
(2) park a motor vehicle within ten feet of a mailbox located along a county roadway.

11.04.020 Penalty for violation.
Any violations of this chapter shall constitute a traffic infraction and be subject to the provisions of chapter 46.63 RCW.

Chapter 11.12 TRAFFIC CODE

11.12.010 Adoption.
The state statute and/or portions or parts of state statutes listed by reference to the Revised Code of Washington, as amended by the Regular and Extraordinary Sessions of the 1969 Legislature of the state of Washington, title, chapter and section numbers in Appendix A, which by this reference are included herein as though set forth in full herein, are adopted.

State statutes, listed by Revised Code of Washington title, chapter and section numbers in Appendix B, which are by this reference included herein as though set forth in full herein, are adopted as specially modified herein.

11.12.020 Title.

This chapter shall be known as the "Snohomish County Traffic Code" and it shall be sufficient to refer to this chapter or any part or portion thereof as the "Snohomish County Traffic Code" in any prosecution for the violation of any provision thereof.

11.12.030 Reference - Prefix change.

Reference to all or any state statutes and/or portions or parts of state statutes listed and adopted by this chapter shall be by Revised Code of Washington title, chapter and section number, but deleting the prefix "RCW" and substituting for prefix the prefix "SCTC" which prefix for the purposes of this chapter shall be the abbreviation for "Snohomish County Traffic Code."

11.12.040 Preservation of prosecuting begun under prior provisions.

Any resolution previously adopted by the board of county commissioners, which is in whole or in part inconsistent with any provision of the Snohomish county traffic code is to that extent repealed; PROVIDED, Any prosecution begun under such inconsistent provision prior to July 1, 1970 shall be preserved.

11.12.050 Violation.

Any person violating any of the provisions or failing to comply with any of the mandatory requirements of this traffic code for which no penalty has been otherwise prescribed shall be guilty of a misdemeanor.

11.12.060 Adoption of RCW amendment.

Any amendment adopted by the Washington State Legislature to any section of the Revised Code of Washington adopted by reference herein is adopted as a part of this traffic code.

11.12.080 Appendix B - RCW sections adopted as modified.

(1) RCW 46.04.431--Highway. Highway means the entire width between the boundary lines of every way, public or private, when any part thereof is open to the use of the public for purposes of vehicular travel.

(2) RCW 46.08.030--Uniformity of application. The provisions of this title relating to the operation of vehicles shall be applicable and uniform upon all persons operating vehicles upon the public highways of this county, except as otherwise provided.

(3) RCW 46.61.500--Reckless Driving.

(a) It shall be unlawful for any person to operate a motor vehicle in a reckless manner as defined by this chapter.

(b) Any person who drives any vehicle in willful or wanton disregard for the safety of persons or property is guilty of reckless driving.

(c) The license or permit to drive or any nonresident privilege of any person convicted of reckless driving shall be suspended by the department for not less than 30 days.

(4) RCW 46.64.060--Stopping motor vehicles for driver's license check, vehicle inspection and test--Purpose. The purpose of RCW 46.64.060 and 46.64.070 is to provide for the exercise of the police power of this state and county to protect the health and safety of its citizens by assuring that only qualified drivers and vehicles which meet minimum equipment standards shall operate upon the highways of this state and county.

(5) RCW 46.64.070--Stopping motor vehicles for driver's license check, vehicle inspection and test-- Authorized powers additional. To carry out the purpose of RCW 46.64.060 and RCW 46.64.070, officers of the Snohomish county sheriff's office are hereby empowered during daylight hours and while using plainly marked Snohomish county sheriff vehicles with red light to require the driver of any motor vehicle being operated on any highway of this county to stop and display his or her driver's license and/or to submit the motor vehicle

being driven by such person to an inspection and test to ascertain whether such vehicle complies with the minimum equipment requirements described by chapter 46.37 RCW, as now or hereafter amended. No criminal citation shall be issued for a period of 10 days after giving a warning ticket pointing out the defect. The powers conferred by RCW 46.64.060 and 46.64.070 are in addition to all other powers conferred by law
upon such officers, including but not limited to powers conferred upon them as police officers pursuant to RCW 46.20.430 and powers conferred by chapter 46.32 RCW.

(6) RCW 46.90.436(2)--Parking for certain purposes unlawful. No person shall park any vehicle upon any highway for the principal purpose of displaying such vehicle for sale.

11.12.090 Effective date.

This traffic code will take effect July 1, 1970.

Chapter 11.16 MAXIMUM SPEED LIMITS


11.16.010 Applicability.
The provisions of this chapter apply to all public roads within unincorporated Snohomish county.

11.16.020 Designated maximum speed limit.
Except as otherwise provided in this chapter, the maximum speed limit that a person may operate a vehicle of any character upon any road in the unincorporated areas of Snohomish county shall be 35 miles per hour.

11.16.030 Designated maximum speed limit - Residential districts.
The maximum speed limit that a person may drive a vehicle of any type on a road in a residential district in the unincorporated area of Snohomish county shall be 25 miles per hour except where a different speed limit has been posted. "Residential District" shall have the same definition as contained in RCW 46.04.470 as it currently exists or as that definition is later amended: "Residence District" means the territory contiguous to and
including a public highway not comprising a business district, when the property on such public highway for a continuous distance of 300 feet or more on either side thereof is in the main improved with residences or residences and buildings in use for business." If RCW 46.04.470 is later amended, the amended language will control over the language in this section.

11.16.040 Designated maximum speed limit - Gravel roads.
The maximum speed limit that a person may drive a vehicle of any type on a gravel road in the unincorporated area of Snohomish county shall be 25 miles per hour except where a different speed limit has been posted.

11.16.050 Violation - Misdemeanor.
Any violation of this chapter shall be a misdemeanor and is punishable in accordance with SCC 1.01.100 as it presently exists or as it is later amended.

11.16.060 Change of existing speed limits - When effective.
Speed limits in effect on the date of the adoption of this chapter shall remain in effect until the director of public works shall change speed limits under the provisions of this chapter or when the Snohomish county council shall, by ordinance, institute speed limit changes and when such changes, in either case, are posted. Prior to the director of public works making a change in a speed limit under the provisions of this chapter, the director shall publish, in a newspaper of general circulation in the county, a notice of the proposed speed limit and the procedure for appealing the proposed speed limit. Any new speed limit will become effective upon posting consistent with the manual on uniform traffic control devices for streets and highways adopted in SCC

11.16.070 Authority - Director of Public Works.
The director of the department of public works is authorized to revise existing speed limits on all county roads PROVIDED That such speed limit revisions shall not exceed 10 miles per hour. The determination of the proper speed limit will be based upon the following engineering and traffic investigation factors:  (1) Road surface characteristics, shoulder conditions, grade, alignment and sight distance;
(2) The 85 percentile speed and pace speed;
(3) Roadside development and roadside friction;
(4) Safe speed for curves or hazardous locations within the zone;
(5) Parking practices and pedestrian activity; and
(6) Reported accident experience for a recent 12-month period.

11.16.080 Appeal procedures.
The decision of the director of the department of public works concerning any speed limit revisions may be appealed by an aggrieved party to the Snohomish county council PROVIDED That an appeal is filed in writing within 30 calendar days from the date of the posting of the new speed zone. Any appeal must be submitted to the clerk of the Snohomish county council, 6th floor, Snohomish County Administration Building, Everett,
Washington, 98201.

11.16.090 Special conditions.
Reduced temporary speed limits for special conditions, such as where there is construction on or near a county road, may be set by the director of public works provided these locations are posted with signs in accordance with the federal highway administration's manual on uniform traffic control devices. Such temporary speed limits may change the posted speed limit by more than 10 miles per hour.

11.16.100 Log of speed limits.
The director of public works shall maintain a log for each established speed limit. The log shall list each road section and the speed limit thereon, and the beginning and ending mile posts for each such road segment.

11.16.110 Reduced speed where persons working.
A maximum speed limit of 20 miles per hour is hereby established for those areas of Snohomish county in which authorized persons are working within the traveled roadway, PROVIDED Said areas are posted with signs in accordance with the federal highway administration's manual on uniform traffic control devices.

11.16.900 Severability.
If any portion of this chapter is held to be invalid, such decision shall not affect the validity of the remaining sections of this chapter. The county council declares that it would have adopted this chapter and each section of it, even if any one or more sections, subsections, sentences, clauses, phrases, parts or portions are declared invalid or unconstitutional.

Chapter 11.24 TRAFFIC CONTROL DEVICES


11.24.010 Adoption of state provisions.
The "Manual on Uniform Traffic Control Devices for Streets and Highways" as amended by the state highway commission, be and is hereby adopted by Snohomish county, to apply to all county roads and streets.

11.24.020 Authority of county engineer.
RCW 46.90.260 and 46.90.265 providing for an office of traffic engineer having certain powers and duties regarding traffic control devices are hereby adopted by reference and the functions thereof assigned to the Snohomish county engineer.

11.24.010. No speed limit change is effective until posted.
(Added Ord. 84-089, § 1, Aug. 27, 1984).


Chapter 11.40 MOTORIZED FOOT SCOOTERS

11.40.010 Definition.

"Motorized foot scooter" means a device with no more than two ten-inch or smaller diameter wheels that has handlebars, is designed to be stood or sat upon by the operator, and is powered by an internal combustion engine or electric motor that is capable of propelling the device with or without human propulsion.

11.40.020 Operation of motorized foot scooters.

(1) It is unlawful for any person to do any of the following:

(a) Operate a motorized foot scooter while under the age of sixteen years;

(b) Operate a motorized foot scooter on a public roadway having a speed limit greater than twenty-five miles per hour;

(c) Operate a motorized foot scooter outside of a marked bicycle lane upon the roadway if one exists;

(d) Operate a motorized foot scooter on county owned property, including a county park;

(e) Operate a motorized foot scooter on a sidewalk, except as may be necessary to enter or leave property adjacent to the sidewalk;

(f) Operate a motorized foot scooter on any public bicycle path or trail or on any public equestrian, hiking, or recreational trail;

(g) Operate a motorized foot scooter at any time from one-half hour after sunset to one-half hour before sunrise;

(h) Operate a motorized foot scooter with a passenger in addition to the operator;

(i) Operate a motorized foot scooter in such a manner as to endanger or be likely to endanger any person or property; operation of a motorized foot scooter in excess of a posted speed limit shall be prima facie evidence of operation in a manner likely to endanger any person or property;

(j) Operate a motorized foot scooter that is not equipped so that the drive motor is engaged through a switch, lever, or other mechanism that, when released, will cause the drive motor to disengage or cease to function;

(k) Operate a motorized foot scooter powered by an internal combustion engine that is not at all times equipped with a muffler in good working order; or

(l) Operate a motorized foot scooter without wearing a protective helmet that meets or exceeds the safety standards set by the United States Consumer Product Safety Commission (CPSC). The helmet must be worn over the head and equipped with either a neck or chinstrap that must be fastened securely while the motorized foot scooter is in motion.

(2) Any person operating a motorized foot scooter upon a public way shall obey all rules of the road as adopted by Title 11 SCC.

11.40.030 Parent Responsibility.

The parent of any child and the guardian of any ward shall not authorize or knowingly permit any such child or ward to violate any of the provisions of this chapter.

11.40.040 Violation Penalty.

Any person violating any provisions of this chapter shall be deemed to have committed a traffic infraction and shall be punished by the imposition of a monetary penalty not to exceed $250.00, exclusive of statutory assessments; provided, conduct that constitutes a criminal traffic offense may be charged as such and subject to the maximum penalties allowed for such offenses.

11.40.050 Severability.

If any provision of this chapter or its application to any person or circumstance is held invalid, the remainder of the chapter or the application of the provision to other persons or circumstances is not affected.
